Important steps to follow if you are arrested or stopped by a police officer

We want individuals stopped by an officer or charged with a crime to follow some basic rules that will help us preserve their rights. If stopped, you should:

  • Be calm and polite.
  • You do have the right to remain silent.
  • Ask to speak to a lawyer.
  • Ask the police officer why you are being detained and whether you are free to leave.
  • Refuse any request to search your vehicle or person.
  • Be prepared to spend at least one night in jail if arrested.
  • Pay attention at the arraignment to the charges or the bail imposed. If you were jailed, you will need to pay the clerk the full amount or a bail bondsman 10 percent of the required amount.
  • Secure the services of an attorney early.
  • Discuss your case only with your lawyer — not with a police officer, jail personnel, others in the cell, or anyone else.
