What to do if arrested or stopped by a police officer

We want individuals stopped by an officer or charged with a crime to follow some basic rules that will help them preserve their rights. If stopped, you should:

  • Be calm, polite, and cooperative.
  • Ask to speak to a lawyer. You do have the right to remain silent.
  • Ask the police officer why you are being detained and whether you are free to leave.
  • Refuse any search of your vehicle or person.
  • Be prepared to spend at least one night in jail if arrested.
  • Pay attention at the arraignment to the charges or the bail imposed. If you were jailed, you will need to pay the clerk the full amount or a bail bondsman 10% of the required amount.
  • Secure the services of an attorney early on.
  • Discuss your case only with your lawyer, not with jail or court personnel.
